Advisory Commission

The ‘Beratende Kommission im Zusammenhang mit der Rückgabe NS-verfolgungsbedingt entzogener Kulturguts, insbesondere aus jüdischem Besitz’ (Advisory Commission on the return of cultural property seized as a result of Nazi persecution, especially Jewish property) met in Berlin on July 14, 2003 for its constitutive meeting. This body was set up subsequent to an agreement between the Beauftragte der Bundesregierung für Kultur und Medien (Federal Commissioner for Cultural and Media Affairs), the Conference of Ministers of Culture of the Länder and the central municipal associations.

It can be appealed to in cases where there are differences regarding the return of cultural objects taken from their owners, especially persecuted Jews, in the Third Reich and which currently are located in museums, libraries, archives or other public institutions in the Federal Republic of Germany. If both sides to the dispute so desire, the Advisory Commission serves as a mediator between representatives of the collections and the former owners of the objects or their heirs. It can suggest proposals in an aim to settle differences of opinion on these matters.

The following have agreed to serve in an honorary capacity on the Advisory Commission: the former President of the Federal Republic of Germany, Dr Richard von Weizsäcker, the former head of the German Bundestag, Professor Rita Süssmuth, the former head of the Federal Constitutional Court, Professor Jutta Limbach, the art historian Professor Thomas Gaehtgens, the philosopher Professor Günther Patzig, the philosopher of jurisprudence Professor Dietmar von der Pfordten, the historian Professor Reinhard Rürup and the philosopher Professor Ursula Wolf.

In the framework of its first constitutive meeting in July 2003, Jutta Limbach was elected chair. Her deputy is Thomas Gaehtgens. The Koordinierungsstelle, as administrative office of the Advisory Commission, has the task of preparation, implementation and follow-up for the meetings of the Advisory Commission. In addition, it serves as contact for individuals who wish to appeal to the Advisory Commission.

Such a request presupposes that the procedure as described in the Gemeinsame Erklärung (Joint Declaration) has been taken into account and that both parties are agreed that the Advisory Commission should deal with their case.
